1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the Camping Wilderness Skills service, including any application, website, platform, or related offering operated under the Camping Wilderness Skills brand (collectively, the "Service"). The Service is operated by Blackwater Outdoor Journeys LC, a Domestic Limited Liability Company ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, Acceptable Use Policy, and Waiver of Liability, each of which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you are at least eighteen years old and have the legal capacity to enter into these Terms.
3. Accounts and Security
To access most features of the Service, you must register an account. You agree to provide accurate and complete information during registration and to keep that information current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.
4. The Service is Not a Life-Safety System
The Service includes location-aware features, trip-planning tools, overdue alerting, weather and water-condition data, educational content, and an AI Coach feature. These features are informational tools only. The Service is not a life-safety, rescue, or emergency-response system. Location data, alerts, weather, water-condition data, and AI Coach responses may be inaccurate, delayed, or unavailable. You are solely responsible for your own safety, your assessment of conditions, your decisions in the field, and the safety of anyone in your party. You must not rely on the Service as your sole source of safety information or as a substitute for emergency services.
5. Subscriptions and Payments
Certain features of the Service require a paid subscription. Subscription fees, billing intervals, and the scope of access associated with each tier are presented at the point of sale. Subscriptions renew automatically until canceled. You may cancel a subscription at any time through your account settings; cancellations take effect at the end of the current billing period. Payments are processed by Stripe, Inc. and are subject to Stripe's terms in addition to these Terms.
6. SMS Messaging Program
If you opt in to SMS messages from the Service, you authorize us to send transactional SMS messages to the phone number you provide. Categories of SMS messages sent to you include account verification, security alerts, password resets, and trip-safety alerts related to your own activity and active trips. Message frequency varies based on your activity. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out at any time. Opt-out is free and stops further SMS messages from the Service to that phone number. Carriers are not liable for delayed or undelivered messages.
7. Acceptable Use
You agree not to use the Service to: violate any applicable law; infringe any third party's rights; transmit malicious code; interfere with the operation or security of the Service; submit false trip-safety information that could trigger unwarranted emergency responses; or harvest, scrape, or otherwise extract data from the Service without our written authorization. We may suspend or terminate access for violations.
8. User Content and Contributor Content
You retain ownership of content you submit to the Service. By submitting content (including trip plans, contributor data, comments, and AI Coach inputs), you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, and display that content for the purpose of operating the Service. Contributor content related to public geographic and environmental data may be retained as part of the Service's content corpus even after your account is deleted, as described in our Privacy Policy.
9. Intellectual Property
The Service, including its software, content, designs, and trademarks, is owned by Blackwater Outdoor Journeys LC or its licensors and is protected by United States and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely as permitted by these Terms.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, error-free, or secure, or that the Service will produce accurate or reliable safety, navigation, weather, or condition information. Outdoor activities carry inherent risks, including risk of serious injury or death. You assume all such risks.
11. Limitation of Liability
To the maximum extent permitted by law, Blackwater Outdoor Journeys LC and its affiliates, officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim and (b) one hundred U.S. dollars (USD 100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Blackwater Outdoor Journeys LC and its affiliates, officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, your violation of these Terms, or your violation of any rights of any third party.
13. Waiver of Liability
Use of the Service is conditioned on your acceptance of our Waiver of Liability, which is presented to you during onboarding. The Waiver of Liability addresses the inherent risks of outdoor activity and the informational-only nature of the Service.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may terminate your account at any time through your account settings. Sections that by their nature survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in Charlton County, Georgia, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. Material updates will be communicated through the Service or by email to the address associated with your account. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
